Welcome to AICVScreen (the "Service"). These Terms of Service ("ToS") govern your use of our website and services. By accessing or using the Service, you agree to be bound by these terms. Please read them carefully.

1. Introduction

AICVScreen allows users to screen CVs (resumes) against job descriptions using advanced AI algorithms. This service is available to both subscribed and non-subscribed users. Subscribed users are granted higher usage limits, while non-subscribed users are provided limited access to the service. AICVScreen supports the submission of CVs, job descriptions, and keywords in multiple languages. The Service includes automatic language detection to efficiently screen documents in the languages they are submitted in. By using the Service, you agree to comply with all the terms outlined herein.

2. User Eligibility

The Service is intended for use by individuals who are at least 18 years old or have the legal capacity to enter into a binding agreement. By using this Service, you confirm that you meet these eligibility requirements. The Service is available globally, subject to applicable laws.

3. Subscriptions & Payments

• Non-Subscribed Users: Non-subscribed users are allowed to screen up to 3 CVs per month, with a maximum file size of 1.5 MB per CV.
• Subscribed Users: Subscribed users can screen up to 300 CV pages per month (e.g., 150 CVs of 2 pages each) with a maximum file size of 1.5 MB per CV. If you reach your 300 CV page limit and would like to continue screening, you have the option to subscribe again for $5.00 (USD) per month. You may either cancel your current subscription and re-subscribe with the same email address, or use a different email address to create a new account. If you choose to use a different email address, each account will have a separate 300 CV page limit per month, and you may manage and delete any of the accounts at any time.
• Subscription Pricing: We offer a single subscription plan priced at $5.00 (USD) per month. There are no hidden fees or long-term contracts, and you may cancel your subscription at any time through your account settings.
• Monthly Subscription: Subscriptions are charged on a monthly basis. If you choose to cancel your subscription, you will retain access to the Service until the end of your current billing cycle. After this period, access will be revoked.
• Payment Terms: Payments are processed monthly, and the subscription fee will be automatically charged to your chosen payment method on the same day each month (the "Billing Date").
• Payment Failures: If a payment fails to process, your account will be deleted after 3 days.
• Changes to Pricing: We reserve the right to modify the subscription pricing at any time. We will notify you of any changes in advance.

4. User Responsibilities

When using the Service, you agree to the following:

• Lawful Use: You will not use the Service for any unlawful or prohibited activities.
• Respect Usage Limits: You agree to adhere to the CV limits based on your subscription level. For non-subscribed users, this means a maximum of 3 CVs per month; for subscribed users, this means up to 300 CV pages per month.
• Accurate Information: You must provide accurate information when creating your account and during any interactions with the Service.
• No Malicious Use: You agree not to tamper with, hack, or otherwise exploit the website or its associated services.
• Right to Submit CVs: You must have the legal right and explicit permission to submit any CV (resume) data through the Service. This means you must either be the person the CV belongs to, or you must have the explicit consent of the individual whose CV you are submitting. By submitting a CV, you confirm that you have the legal right and explicit permission to do so.
• No Unauthorized Submissions: Submitting another person's CV without their consent is strictly prohibited.

5. Consent for Data Processing

By using the Service, you consent to the processing of personal data contained in CVs (resumes) for the purpose of screening them against the job descriptions you provide. This processing is necessary to fulfill the service provided. The CVs and the data contained within them are used exclusively for this screening purpose and are deleted after the screening process is completed. They are not stored or shared with any third parties.

You may not copy, modify, distribute, or use any of the content without prior written consent from the site owner, except as expressly permitted for the use of the results of the CV screenings as part of the Service. Users are allowed to download, use, and store screening results for their personal or business use related to their subscription, provided such use is legal. Distribution or public sharing of these results requires prior written consent from the site owner.

10. Liability and Disclaimers

The Service is provided "as is" and without warranties of any kind, either express or implied. We make no guarantees about the accuracy, reliability, or availability of the Service. To the fullest extent permitted by law, we will not be liable for any damages arising from the use of or inability to use the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

You acknowledge and agree that we will not be held liable for any delays or failures in the performance of the Service due to circumstances beyond our control, including but not limited to technical issues, server outages, or resource limitations, as well as circumstances that are within our control, where resolution may not be immediate.

As the sole operator of the Service, there may be instances where immediate resolution of issues is not feasible. Therefore, we cannot guarantee uninterrupted access or timely resolution of any problems that may arise.

We do not assume responsibility for CVs that are incorrectly analyzed or for any decisions made based on the information generated by the Service. Users are solely responsible for any actions taken based on the results of the Service.

11. Account Suspension or Termination

We reserve the right to suspend or terminate your account if you violate any terms of this ToS, engage in fraudulent or illegal activities, or misuse the Service. If your account is terminated due to a breach of these terms, you will not be entitled to any refund for any unused portion of your subscription.

12. Changes to the Terms of Service

We may update these Terms of Service from time to time. Any changes will be posted on this page, and we encourage you to review the terms regularly. By continuing to use the Service after changes are posted, you agree to be bound by the updated ToS.

13. Force Majeure

We will not be held liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, labor disputes, government actions, failure of third-party services, and interruptions in the internet or telecommunications networks ("Force Majeure Event"). During the occurrence of a Force Majeure Event, our obligations will be suspended for the period of the event. We will make reasonable efforts to resume the Service as soon as possible following the cessation of the Force Majeure Event.

14. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to them, your use of the Service, or any related matters, will be governed by and construed in accordance with the laws of the United Kingdom. You agree that any legal actions or proceedings arising from or related to the Service will be brought exclusively in the courts located in the United Kingdom, and you hereby submit to the personal jurisdiction of such courts.
